Considerando o número de jogos da Activision desaparecidos, é surpreendente, especialmente considerando que Phil Spencer, CEO da Microsoft Gaming, anunciou em 2022 que “pretende disponibilizar a adorada biblioteca de jogos da Activision Blizzard — incluindo Overwatch, Diablo e Call of Duty — no Game Pass e aumentar as comunidades de jogadores”. Embora Diablo e alguns títulos de Call of Duty tenham chegado ao serviço, vários títulos cult, como Prototype, ainda estão desaparecidos.
Mas por que esses jogos não chegaram ao Xbox Game Pass?
A ausência de certos jogos no Xbox Game Pass se deve a obstáculos legais difíceis de resolver. Muitos títulos estão bloqueados devido a licenças expiradas, efeitos sonoros protegidos ou detentores de direitos não identificáveis. Jogos como Prototype ou a série Transformers no Xbox 360 frequentemente surgem nessas discussões, assim como MechAssault, cujos direitos são divididos entre vários proprietários.
Embora a Microsoft detenha as licenças BattleTech e MechWarrior para o videogame, a complexidade desses acordos impede um processo de republicação direto. A empresa, portanto, está agindo com cautela para evitar qualquer possível litígio.
Além dessas restrições legais, a estratégia da Microsoft, sem dúvida, também depende do equilíbrio do Game Pass. Adicionar dezenas de títulos do catálogo da Activision de uma só vez poderia prejudicar a visibilidade de estúdios terceirizados e independentes, que dependem dos royalties gerados pela plataforma para continuar se financiando. Tal desequilíbrio enfraqueceria as relações de confiança que a Microsoft busca manter com seus parceiros.
A situação é ainda mais complicada pelo crescimento estagnado do Game Pass, especialmente no segmento de consoles. A Microsoft precisa, portanto, gerenciar sua oferta com cuidado, mesmo que pareça conservadora demais. No entanto, alguns acreditam que adicionar jogos retrô icônicos, como Call of Duty da era do Xbox 360, reacenderia o interesse no ecossistema Xbox. No entanto, muitos jogos Call of Duty já foram portados para a Microsoft Store para PC, o que sugere uma chegada iminente ao serviço.
